New Zealand

For roles in New Zealand these points apply in addition to the rest of these Terms. Candidates never pay to use this board.

  • Employers and recruitment agencies must follow New Zealand law, including the Employment Relations Act 2000, the Human Rights Act 1993 (no discriminatory requirements, such as age, sex or nationality, in a listing) and the Fair Trading Act 1986 (a listing must not mislead).
  • Before employing someone, the employer must check that the person is entitled to work in New Zealand (Immigration Act 2009). A candidate’s declaration on this board does not replace that check.
  • A recruitment agency that lists a role names itself as the lister and may keep its client confidential. It must have its client’s authority to advertise the role.
  • We do not give immigration advice. For information, see Immigration New Zealand; for advice on your own situation, see a licensed immigration adviser or a lawyer.

1. Acceptance of Terms

By accessing or using Queenstown.Jobs ("the Platform"), operated by Beyond Peaks LLC (Beyond Peaks合同会社) ("Beyond Peaks", "we", "us"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use the Platform.

2. The Service

The Platform is an online job board and community for the Queenstown region: it hosts job listings, employer profiles, candidate profiles, applications, reviews, messaging, and informational visa and work-readiness tools. We provide the venue for candidates and employers to find each other. We are not an employment placement agency, staffing agency, or recruiter; we are not a party to any employment agreement; and we do not guarantee that any candidate will be hired or that any employer will find staff.

3. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use the Platform. Employer accounts must be created by authorized representatives of the business, who warrant that they have authority to bind it.

4. Account Registration

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You agree to provide accurate and current information during registration and to keep it up to date.
  • You may not create multiple accounts, share an account, or impersonate another person or business.
  • We reserve the right to suspend or terminate accounts that violate these terms.

5. Candidate Terms

  • Job applications are submitted at your own discretion. We do not guarantee employment or interview outcomes.
  • When you apply, a snapshot of the profile information you submit is shared with that employer, as described in our Privacy Policy.
  • If you opt in to scouting, the profile details you choose to show become visible to registered employers until you opt out.
  • You may not submit fraudulent applications, misrepresent your qualifications, identity, or work eligibility, or apply on behalf of someone else.
  • Reviews you submit must be truthful, based on genuine personal work experience, and comply with our Review Guidelines.

6. Employer Terms

  • Job postings must be accurate, complete, non-discriminatory, and for genuine, currently available positions. Stated wages, hours, housing, and other conditions must match what is actually offered.
  • You must comply with the employment and immigration law that applies to the role, which for New Zealand roles is set out in the New Zealand section above.
  • You must be legally able to employ the people you hire, and any claim you make about visa support must be truthful. Misrepresentation may result in immediate suspension.
  • Candidate information you receive through the Platform may be used only to evaluate and communicate about genuine job opportunities. You must keep it confidential, protect it in accordance with applicable data protection law, and delete it when it is no longer needed for that purpose.
  • You may not contact candidates for purposes other than legitimate job opportunities, or add them to marketing lists without their separate consent.
  • Fees apply to certain employer services as described in Section 7.

7. Fees and Payment

  • Use of the Platform is free for candidates. Certain employer services (such as additional job listings, season passes, or featured placement) are paid; the applicable price is communicated before you purchase.
  • All prices are exclusive of Japanese consumption tax, which is added and itemized separately on every quote and invoice.
  • We do not charge a success fee: no placement fee, commission, or salary percentage is triggered simply because you hire someone through the Platform, unless a separate written agreement provides otherwise.
  • Unless otherwise agreed, payment is due before paid services are activated, and we may suspend paid features or listings while payment is overdue.
  • Paid products are non-refundable once activated, except where required by law, where non-delivery was our fault, or where we expressly agree; we may offer goodwill credits or extensions at our discretion.
  • Season or unlimited listing products are subject to fair use: listings must be genuine openings of your own business or group, and we may merge, edit, or remove duplicative, misleading, or third-party listings.
  • We may change our fees prospectively with reasonable advance notice; changes do not affect services already purchased.

8. Visa and Immigration Disclaimer

Information about work rights on this board is general information only. It is not immigration advice and not a statement that anyone can work in New Zealand. Candidates declare their own work rights; employers confirm them before an offer. All visa decisions rest with Immigration New Zealand.

9. AI Features

Some features (job matching, resume extraction, translation, and readiness assessments) are assisted by artificial intelligence, as described in our Privacy Policy. AI output can be incomplete or inaccurate. It is provided for convenience and information only; you should verify anything you rely on, and we accept no liability for decisions made in reliance on AI-generated content.

10. Reviews and User Content

  • All reviews are subject to moderation before publication, and content may be machine-translated between English and Japanese.
  • Reviews and other content must not contain hate speech, personal attacks, defamation, false statements of fact, other people's personal information, or confidential business information.
  • You are solely responsible for content you submit, including any legal liability arising from it (for example, defamation claims).
  • We may remove, decline to publish, or anonymize content at our discretion, including in response to legitimate legal complaints, but we are under no obligation to monitor content.
  • By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, translate, and distribute it on the Platform and in Platform promotion, with attribution to your chosen display name only.

11. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law.
  • Scrape, harvest, or collect data or personal information from the Platform without our written permission.
  • Interfere with the operation or security of the Platform, or probe, bypass, or test its security measures.
  • Post spam, misleading content, or unsolicited advertisements.
  • Attempt to access other users' accounts or private data.
  • Upload malicious code or content you do not have the right to share.

12. Intellectual Property

All content, features, and functionality of the Platform (excluding user-generated content) are owned by Beyond Peaks or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce or exploit Platform content beyond normal personal use of the service without our permission.

13. Third-Party Services

The Platform may link to or interoperate with third-party websites and services (including employer websites and our partner immigration specialist). Those services are governed by their own terms and privacy policies, and we are not responsible for them.

14. Service Availability and Changes

We may modify, suspend, or discontinue any part of the Platform, and may migrate the Platform between technical providers and infrastructure, at any time. We do not guarantee uninterrupted or error-free operation. If we permanently discontinue a material part of the service or these changes materially affect paid services, we will give registered users reasonable advance notice.

15. Disclaimer of Warranties

The Platform is provided "as is" and "as available". To the extent permitted by law, we make no warranties, express or implied, about the Platform, including the accuracy of listings, employer or candidate information, reviews, translations, AI output, or employment outcomes.

16. Limitation of Liability

To the extent permitted by law, our total liability to you for claims arising out of or related to the Platform is limited to the greater of the fees you paid us in the 12 months before the claim arose or ¥10,000, and we are not liable for indirect, incidental, consequential, or special damages, or for lost profits or data. Nothing in these Terms excludes or limits liability that cannot be excluded under Japanese law, including liability for our willful misconduct or gross negligence, and nothing affects mandatory consumer protections under the Consumer Contract Act (消費者契約法) where you use the Platform as a consumer.

17. Indemnification

You agree to indemnify and hold harmless Beyond Peaks from claims, damages, and reasonable expenses brought by third parties arising from content you submit, your violation of these Terms, or your violation of law or third-party rights — except to the extent caused by our own breach or negligence.

18. Termination

You may close your account at any time. We may suspend or terminate your access for conduct that violates these Terms or is harmful to other users or the Platform, with notice where practicable. Sections that by their nature should survive (including content licenses, fees owed, disclaimers, liability limits, and governing law) survive termination. Deletion of personal data on termination is handled as described in our Privacy Policy.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any dispute arising out of or relating to these Terms or the Platform, except where mandatory law provides otherwise.

20. Language

These Terms may be provided in Japanese and English. In the event of any inconsistency, the Japanese version governs, except where applicable law requires otherwise.

21. General

If any provision of these Terms is held invalid, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent; we may assign these Terms in connection with a merger or business transfer, in which case we will notify you. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Platform. Neither party is liable for delay or failure caused by events beyond its reasonable control.

22. Changes to Terms

We may modify these Terms from time to time. We will notify registered users of material changes by email or platform notification before they take effect; continued use of the Platform after the effective date constitutes acceptance.
